Georgia County of Wilcox
Myrtis Collins Ware of the State and County aforesaid being of sound and
disposing mind and memory do make this my last will and testament hereby
revoking all wills heretofore made by me.
I wish my Executor hereafter named as early as possible after my death
to pay all my just debts if a sale of any of my property shall be
necessary for this purpose I wish him to select such as can be used most
advantageously for that purpose and I authorize him to sell same either
at public or private sale as he may deem best without any order or
further authority of Court.
I give and bequeath to my husband Lava Ware the sum of Twenty five
Dollars ($25.00) to be paid in cash the provision to be in full of all
his claims or demands of all kinds against my estate.
I will that the residue of my property both real and personal be equally
divided among my children to wit: Ruth Collins and Emma Collins and the
unborn child with which I am now pregnant each receiving one third of
the residue of my property. But in case the child with which I am now
pregnant shall not reach birth alive or shall die before my death it is
my will that the residue of my property be equally divided between my
two living children to wit: Ruth Collins and Emma Collins each receiving
one half of the residue of my estate.
It is the wish and desire of testator that in case of her death before
the said Ruth Collins and Emma Collins reach their respective majorities
that my father W.N. Jones be appointed Guardian of the persons and
property of each.
I do hereby Constitute and appoint my father W.N. Jones executor of this
my will and do hereby relieve him of the necessity of making any bond or
annual reports to the Court of Ordinary and I authorize him to sell any
property real or personal belonging to my estate either at public or
private sale without the necessity of obtaining any order of the Court
of Ordinary and further authorize him to manage or dispose of my
property for the benefit of my children as he may deem best for their
interests reposing the utmost confidence in his Judgment and
trustworthiness. In testimony whereof I have hereto set my hand this 4th
day of May 1914.
