I, John W. Byers of said State and County being of sound and disposing mind and memory do make this my last will and testament hereby revoking all will heretofore made by me.

Item 1st I wish my Executor and Executrix as soon as possible after my death to pay my debts and for that purpose I authorize them to sell any of my property either at public or private sales as they may see fit.

Item 2nd I give to my beloved wife Mrs. Francis M. Byers the following property to wit: Sixty acres of land more or less described as following commencing at the original North-East corner of lot of land number (105) one hundred and five in the (12th) Twelfth district of said County and running South on the original land line half the width of said lot to a point equal distant between the North East Corner and the South East corner of said lot then running South West across the field to a point Sixty feet South of my barn, thence running west to a point sixty yards west thence running due North back to the original lot line on which is now located my residence barn and other house. Also a horse or mule and buggy one cow and calf and all the household goods of every kind and nature. Also all the crops raised on said lot of land number 105 during the year that I may die.

Item 3rd I give to all my other heirs to wit: Mrs. Julia Roberts, Mrs. Emma Field, Walter Byers, the children of Ramond Byers deceased, Mrs. Minnie Williford, Marion Byers and Hershal Byers the remainder of lot of land number (105) one hundred and five, to share equally, share and share alike and I desire that the same be de divided equally between them, and for that purpose I hereby authorize my Executor and Executrix to sell the same either at public or private sale.

Item 4th I do hereby appoint my wife Mrs. Francis M. Byers My Executrix and my friend L.G. Gibbs Executor to act jointly and carry out the provisions of this will in conformity to law. In Witness whereof I have hereunto set my hand this 3rd day of April 1913.

Signed and published by John W. Byers as his last will and testament in the presence of the undersigned who subscribe our names hereto as Witnesses at the instance and request of said testator and in his presence and in the presence of each other this the 3rd day of April 1913.
