Last Will
and Testament

Note from
transcriber: this will is very faded and hard to read. Parts of it have
been written over by someone years ago. I have tried to figure out what
was written to the best of my ability. I apologize if mistakes are made.
State of

In the name
of God amen, I Hozias Davis of said County & State, being of advanced
age but of sound & disposing & memory knowing that I must shortly depart
this life; deem it right & proper both as respects my family & myself
that hereby make a disposition of the property which a kind Providence
has blessed me, I do therefore make this my Last Will & Testament hereby
revoking & annulling all others by me heretofore made.
1st
I desire that my body be buried in decent & christianlike manner
suitable to my circumstances & condition in life & my soul I trust to
rest with God who gave it. I hope for salvation through the (illegible
word) and atonement of the Lord & Saviour Jesus Christ.
2nd
I desire that all my just debts be paid without delay by my executor
hereinafter named and appointed.
3rd
Item I give and bequeath & devise to my beloved daughter Roda (illegible
words) lot of land no. 202 contain fifty more or less, part of lot no.
212 contain fifty acres more or less both of said (illegible) lying and
being in the first district of originally Irwin, but now Wilcox County
with all members and appurtenances thereunto belong free from all
charge and encumbrance & belonging free from all charge & limitation
whatever (illegible words) use benefit & behoof forever with full
(illegible words) or otherwise as she may deem proper, I also give &
bequeath to my beloved daughter in same unreserved manner the farming
utensils of kinds & sorts that I have & possess & all my household and
kitchen furniture & all of my cattle & sheep & hogs & of my books of
every description & any of my provisions that I may have on hand at my
death.
4th
Item I have hereto now given to my son Zain (?) L. Davis & my daughter
Sophia E. Regans & my daughter Margaret M. Regan their full
distribution share & portion of my property which property is not named
in this my last Will and Testament as they know have I have given them
in their possession (illegible) & no residue of all my property both
real & personal, whereon or whatever is may be I also give & bequeath &
devise to my said Roda A. Jones in fee simple full & forever; & I hereby
appoint my beloved daughter Roda A.P. Jones & my friend Stephen Bowen
executor of this my last will & testament.

Testament in the presence of us the undersigned who subscribe names in
the presence of said Testator at his special instance & request & in the
presence of each other this Dec. 24th 1866.

D. C. Mann Ordinary of said county came Stephen Bowen executor & Roda A.
P. Jones executrix of the last Will & Testament of H. L. Davis deceased,
late of said County & also E. B. Mixon one of the witnesses who being
duly sworn depose & says that he saw the said H. L. Davis sign, seal,
Publish & declare the instrument as his last will & testament
voluntarily & freely without compulsion & then he signed said will as a
witness in the presence of H. L. Davis & the other witnesses.
