State of Georgia Wilcox County

 

In the name of God Amen. I, Daniel Ezekiel Gammage of said State and County being of sound mind and memory knowing that I must depart this life deem it right and proper as respects myself and family that I should make a disposition of the property with which a kid Providence has blessed me with I do therefore make this my last will and testament hereby revoking and annulling all others by me heretofore made.

First

I desire and direct that my body be buried in the Pineview Cemetary in a decent and Christianlike manner with Masonic Honors suitable to my circumstances and conditions in life My soul I trust shall return to rest with God who gave it as I hope for salvation their the merits and atonement of the blessed Lord and Savior Jesus Christ.

Second

I wish my Executor hereinafter named and appointed as soon as possible after my death to pay all my debts and any Securities being treated as individual the principal first failing and refusing to take care of same.

Third

I give to my beloved wife Lizzie Lena Gammage the sum of Eighteen Hundred $1800.00 Dollars The foregoing provision to be made in full extinguishment of her whole interest in my estate and expressly in lieu of her right to a years support and dower in my Real Estate.

Fourth

All the rest and residue of my property both real and personal of every kind and character wherever located I give to my son George Francis Gammage in fee simple. I hereby appoint my brother James Thomas Gammage Guardian of the person and property of my said minor son George Francis especially relieving said Guardian of giving bond making any returns to any Court or accounting to nay Court for his acts as such Guardian.

Fifth

And should this brother James Thomas Gammage not live till this my minor son George Francis is Twenty one (21) years old I hereby appoint my youngest brother Monroe Elijah Gammage to take his place and carry into execution this will as set forth.

Sixth And further at any time this my minor son (now) die and not leave any legal heirs of his body I direct that this bequeathment together with any property in his hands at that time be equally divided between James Thomas Ruel Lee Monroe Elijah Gammage my brothers and Georgia A. Dubose a Sister or their estates.

Seventh

I hereby constitute and appoint my trusted brother James Thomas Gammage Executor of this my Last Will and Testament and I expressly Confer upon him power as such to administer my estate relieving him from giving any bond or making any returns to the Ordinary except that he shall make and file and inventory of all my property. I further expressly confer upon my executor full authority to sell all or any part of my estate at public or private sale with or without notice as he may deem best and without any order of Court making good and sufficient title to the purchases and holding the proceeds to the same uses and trust as hereinbefore declared in eh several items of this my will.

Eighth

It is my will and desire that my said Executor shall keep my estate together and manage the same until such time as he in his discussions shall deem wise proper and for the best interest of the beneficiaries named herein to dispose of same and make a division thereof and to that end I hereby expressly confer upon him full power and authority to bind my estate in any instance where he may think it necessary and proper and to secure the same by lien mortgage security deed or trust deed and this he may do privately without any order of Court and without accounting to or making returns to any Court.

In testimony whereof I have hereunto set my hand this 31st day of March 1915.

Signed Sealed declared and published by Daniel Ezekiel Gammage as his last will and testament in the presence of the undersigned who subscribe our names thereto as Witnesses at the special instance and request of said testator after he had singed his name thereto and in his presence and in the presence of each other This 31st day of March 1916.
